The brother of Michael Rustell has said his family can finally grieve for him, after his killer was sentenced to 16 months imprisonment for causing the crash which cost him his life.

Alexander Siu Kit Lee, 22, of Park Road, Melksham, pleaded guilty to causing death by careless driving at Salisbury Magistrates’ Court in May, and was sentenced on Friday at Winchester Crown Court.

As well as a prison sentence he has been banned from driving for three years, and will have to take a retest before regaining his licence.

Mr Rustell, 50, who was the longest-serving player at Beckington Cricket Club, was killed on February 2 when Lee’s modified Volkswagen Golf collided with his Rover 500 on the A36 near Norridge Woods, shortly after 5pm.

At the magistrates hearing in May the court heard how Mr Lee had become “frustrated and impatient” as he waited behind a line of slow-moving cars, and began “bunny-hopping” them, until he was behind a HGV.

In an “obviously risky and dangerous” manoeuvre, he attempted to overtake it on a blind bend, and crashed head-first into the father of four. Mr Rustell was pronounced dead at the scene. Lee suffered minor injuries.

Several members of the Rustell family were in court to hear the sentence. Speaking after the hearing, his brother Ian welcomed the prison term but expressed his disappointment that Lee had not been convicted for dangerous driving.

He said: “I think he was very lucky to get away with careless driving.

“It could have been better, but it could have been a lot worse for us as a family if he had community service and didn’t go to prison, but it still doesn’t bring Michael back.

“We are a very close family, and the loss of Michael is devastating, but this will hopefully put it to rest and we will be able to grieve properly, and make some sense of what’s happened.”
